Sign togetherYou sign while both witnesses watch. Then each witness signs while you and the other witness watch.
Keep it safePut the signed original somewhere safe, and let your executor know where to find it.

Will my Will be legally valid?

Who should be my executor?

Someone you trust who is organised and caring, often a partner, adult child or close friend. They can also be someone who receives something in your Will. It is a kind idea to ask them first, and to name a backup too.

What is the difference between an executor and an attorney? Can it be the same person?

Yes, it can be the same person, and many people choose one trusted person for both roles. The two roles simply happen at different times and do different jobs:

  • Your attorney is appointed in your Enduring Power of Attorney. They help while you are alive but unable to manage things yourself, for example after an accident or illness. They pay your bills, manage your accounts and look after your property, always in your best interests. Their role ends when you pass away.
  • Your executor is named in your Will. They step in after you pass away. They gather your assets, pay any debts and tax, apply for probate if it is needed, and share your estate exactly as your Will says.

A simple way to remember it: your attorney looks after you, and your executor looks after your wishes.

Can my partner and I order together?

Each Will is ordered separately, so you each complete your own. This keeps each Will personal to you.

What is the 5 Year Unlimited Update?

For $99 more, you can update your Will as many times as you like for 5 years. Each new Will simply needs to be signed and witnessed again.

Is a Will enough, or do I need a testamentary trust?

How a Testamentary Trust Works

It sounds complicated, but the idea is simple. Instead of your family receiving their inheritance directly, it goes into a trust that they control. Nothing is set up while you are alive. The trust only begins after you pass away.

Why do I need this if my family will help anyway?

When does it start?

Both let you choose who receives your assets, your executor, and who cares for your children and pets. A Will with Testamentary Trust also lets your family receive their inheritance through a trust, which can help them pay less tax and protect what you leave them.

How do I know if a testamentary trust is right for me?

It may suit you if any of these apply:

  • You have children or grandchildren under 18
  • You are leaving a home, savings or investments of real value
  • A loved one may face divorce, bankruptcy or money troubles
  • You would like your family to have more choice in how they use their inheritance

If none of these apply, a standard Will is usually enough.

Why does a Will with Testamentary Trust cost more?

It is a longer, more detailed document. It includes trust rules for your family, so they can use the tax and protection benefits after you are gone.

Who should I choose as my executor?

Someone you trust, who is organised and likely to be around for many years, often a partner, adult child or close friend. They can also be someone who receives something in your Will. It is kind to ask them first, and to name a backup.

What is the difference between an executor and an attorney? Can it be the same person?

Yes, it can be the same person, and many people choose one trusted person for both roles. The two roles simply happen at different times and do different jobs:

  • Your attorney is appointed in your Enduring Power of Attorney. They help while you are alive but unable to manage things yourself, for example after an accident or illness. They pay your bills, manage your accounts and look after your property, always in your best interests. Their role ends when you pass away.
  • Your executor is named in your Will. They step in after you pass away. They gather your assets, pay any debts and tax, apply for probate if it is needed, and share your estate exactly as your Will says.

A simple way to remember it: your attorney looks after you, and your executor looks after your wishes.

Can I leave someone out of my Will?

Yes, you can choose who to include. However, in Australia some family members, such as a partner or child, can make a family provision claim asking a court to change your Will if they feel they were not properly provided for. If you think this might happen, we would gently suggest reaching out to a qualified solicitor.

Is there anything my Will does not cover?

Yes. A few things are usually not passed on by your Will:

  • Superannuation: paid by your super fund. Ask your fund about a death benefit nomination.
  • Property you own as "joint tenants": usually passes straight to the other owner.
  • Some life insurance: may be paid straight to the person you nominated.

It is worth checking these so everything lines up with your wishes.

I have property or money overseas. Is that covered?

Your Will can mention overseas assets, but other countries have their own rules. You may need a separate Will in that country, so we suggest getting local advice.

EPOA & Guardianship

What is the difference between an EPOA and Guardianship?

An Enduring Power of Attorney covers money and property, such as paying bills, managing accounts and looking after your home. Guardianship covers health and lifestyle, such as medical treatment and where you live. Some states cover both in one document; others need two.

What happens if I lose capacity and have neither?

Your family may not be able to manage your money or make decisions for you, even if they are your partner or children. Someone may need to apply to a state tribunal to be appointed, which can take time, add stress, and may result in someone being appointed whom you would not have chosen.

Can I choose more than one person?

Yes. You can choose whether they must decide together, or can each act alone, and you can name backups.

Signing, storing and updating

How do I sign my documents?

Your execution instructions walk you through it step by step for your state. For a Will, you sign in front of two adult witnesses who are not receiving anything in it. EPOA and Guardianship documents have their own witness rules, which we explain for your state.

Where should I keep my signed Will?

Somewhere safe and dry, such as a fireproof box at home or with a solicitor. Most importantly, let your executor know where to find it. Your Will is also saved in your login, so you can access it anytime, anywhere.

How often should I review my Will?

Every few years, and whenever something important happens, such as marriage, separation, a new child or grandchild, buying a home, or if someone you named can no longer help.

Does getting married or divorced affect my Will?

Yes. In most states, getting married can cancel your existing Will, and divorce can cancel gifts to your former partner. Separation on its own usually does not. It is best to update your Will after any of these changes.

How do I update my Will later?

Add the 5 Year Unlimited Update when you order: $99 for a Will, or $300 for a Will with Testamentary Trust. Then you can update as often as you like for 5 years. Each new Will needs to be signed and witnessed again.

I am moving interstate. Do I need new documents?

Your Will generally still works in another state. Your EPOA and Guardianship documents may need to be redone, because the forms and rules are different in each state.
